Plain-language summary
This summary is for convenience only; the full Terms below are what bind us both.
- Bricko is free. There is no subscription, licence, listing, transaction or commission fee for using Bricko ERP, Bricko CRM, Unified Finance, BrickoMart or the Home Buyer Portal.
- We charge only for advertising. If you choose to run sponsored placements or campaigns on Bricko, you pay for those ads, and only those ads, at the prices shown when you book them.
- You contract with Bricko Catalyst Private Limited, an Indian company based in Nagpur, Maharashtra, wherever in the world you use Bricko.
- BrickoMart is a marketplace. Suppliers, consultants and brands sell and serve you directly. Bricko connects you, verifies business details and helps resolve problems, but it is not the seller.
- Your data stays yours. Builders who run their business on Bricko ERP and CRM own their customer data; Bricko processes it only on their instructions.
- Keep it legal and honest. No fake listings, no misleading prices, no content that belongs to someone else, no harassment. We can remove content and close accounts that break these rules.
- Problems? Write to our Grievance Officer (details in Section 20). We acknowledge within 24 hours and resolve as quickly as we can.
1. Who we are and what these Terms cover
1.1 These Terms of Service ("Terms") are a legally binding agreement between you and Bricko Catalyst Private Limited, a company incorporated under the Companies Act, 2013, with its registered office in Nagpur, Maharashtra, India ("Bricko", "we", "us", "our").
1.2 They govern your access to and use of all Bricko products, websites and applications (together, the "Services"), including:
- Bricko ERP, Bricko CRM and Unified Finance — the construction project-management, sales and finance software for builders and developers at brickoerp.com, its sign-in and sign-up sub-domains, and customer workspaces on *.brickoerp.com (the "Platform");
- BrickoMart — the business-to-business building-materials marketplace at brickomart.com, including its buyer, supplier, consultant, brand and delivery-partner portals and the BrickoMart web app (the "Marketplace");
- The Home Buyer Portal at bricko.in, where home buyers discover homes from participating builders and track their bookings (the "Portal");
- any mobile applications, progressive web apps, driver apps, APIs, integrations, help content and communications we provide.
1.3 These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They do not need a physical or digital signature. You accept these Terms by a clear affirmative act — ticking the acceptance box or clicking "I agree" when you create an account, or confirming acceptance when we publish a new version — and by continuing to use the Services after that. Our Privacy Policy is the notice that explains how we handle personal data; it forms part of these Terms, and the consents it describes are collected separately and are never bundled with your acceptance of these Terms.
1.4 These Terms were published to meet the requirements of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended, which require intermediaries to publish their rules and regulations, privacy policy and user agreement.
1.5 If you use the Services on behalf of a company, firm, LLP, builder, promoter, trust or any other organisation, you confirm that you are authorised to bind that organisation to these Terms, and "you" means that organisation and you together.
2. Who can use Bricko
2.1 You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872 (or the equivalent law where you live). The Services are built for businesses and for adults buying homes; we do not knowingly allow anyone under 18 to use them.
2.2 You may not use the Services if you are located in, or ordinarily resident in, a country or region that is subject to comprehensive sanctions by India, the United Nations, the United States, the United Kingdom, the European Union or the United Arab Emirates, or if you appear on any sanctions or denied-party list maintained by those authorities. We may screen users, suppliers, brands and partners against these lists and may geo-block affected regions.
2.3 We may refuse, suspend or restrict any account at our reasonable discretion, for example where we cannot verify your identity or business details or where we believe the account is being used in breach of these Terms.
3. Your account
3.1 Roles. The Services offer different account types — builder or developer (Platform customer), buyer, supplier, consultant, brand, delivery partner and home buyer. Each role sees different features. Some roles need verification before full access (see Section 7).
3.2 Accurate information. You must give us true, current and complete information when you register and keep it up to date. If we discover that details are false, misleading or belong to someone else, we may suspend or close the account.
3.3 Security. You are responsible for everything that happens under your account. Keep your password and one-time passcodes private, do not share accounts, and tell us immediately at [email protected] (BrickoERP and Bricko Homes accounts) or [email protected] (all other accounts) if you suspect unauthorised use. We will never ask for your password.
3.4 Workspace administrators. Where an organisation sets up a workspace on the Platform, the person who creates it is its administrator and can invite, manage and remove users. The organisation is responsible for the acts and omissions of its users.
3.5 One real account. You may not create multiple accounts to evade suspension, manipulate rankings, reviews, quotes or ad auctions, or impersonate anyone.
4. Bricko is free
4.1 No platform fees. We do not charge any subscription, licence, seat, project, listing, transaction, success or commission fee for using the Platform, the Marketplace or the Portal. "Free" means free: there is no trial period that converts to a paid plan, no card is required to sign up, and nothing is auto-charged.
4.2 The only paid service is advertising. The only service we charge for is the display of advertisements and sponsored placements under Section 5 ("Advertising Services"). You only ever pay if you choose to book advertising.
4.3 Future optional services. We may introduce optional paid features or premium services in future. If we do, we will say clearly, before you use them, what they cost; we will never charge you for them without your express, affirmative agreement; and the core Services will remain free as described in 4.1 unless we give you at least 60 days' notice of a change.
4.4 Costs that are not ours. "Free" refers to Bricko's own charges. Goods and services you buy from suppliers or consultants on the Marketplace, homes you book through a builder, data and device costs, taxes and bank charges are not Bricko charges.
4.5 What free does not mean. Because the Services are provided without charge, Sections 15 (disclaimers) and 16 (limitation of liability) apply with particular force. Free does not mean unsupported: we provide reasonable support by email and in-app help, but we do not promise service levels or uptime for the free Services.
5. Advertising Services
5.1 What you can buy. Suppliers, brands, consultants, builders and other business users may book sponsored placements, featured listings, banners, promoted catalogues and campaigns that are displayed to users of the Marketplace and the Platform ("Ads"). The formats available, their position and how they are priced are shown in the Ads section of your portal at the time of booking. We do not currently sell paid promotion of real-estate projects or units on the Home Buyer Portal; if we introduce it, we will update these Terms first and comply with the registration and advertising requirements of the applicable real-estate law.
5.2 How you are charged. Ads are charged for display only. Depending on the format, the price is expressed per display (impression), per placement period, or per campaign, as stated on the booking screen. We never charge for clicks, leads, enquiries, bookings or sales that result from an Ad, and no part of our advertising price is a commission or success fee.
5.3 Ad credits. Advertising is prepaid. You add ad credits to your account in Indian Rupees (subject to the minimum top-up shown in your portal). Credits are deducted as your Ads are displayed. Credits can be used only to pay Bricko for Advertising Services; they can never be used to pay a supplier, consultant, builder or any other person, and they are not a wallet or payment instrument. Credits are not money, carry no interest, cannot be transferred to another account, and cannot be redeemed for cash except as set out in 5.7. Credits do not expire while your account remains active and in good standing.
5.4 Taxes. Prices for Advertising Services are exclusive of Goods and Services Tax, which is added at the applicable rate (currently 18%). We issue a GST-compliant tax invoice for every top-up or campaign in the name of Bricko Catalyst Private Limited. If you are required by law to deduct tax at source, you must do so correctly and give us the corresponding certificate; our invoices are issued for the gross amount. Advertisers outside India are responsible for any taxes due in their own country.
5.5 Content standards for Ads. You are responsible for your Ads. Every Ad must: be truthful and substantiated; comply with the Advertising Standards Council of India Code, the Consumer Protection Act, 2019, the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022, the Real Estate (Regulation and Development) Act, 2016 and the rules of the relevant state authority (for Maharashtra: every advertisement of a real-estate project must carry the MahaRERA registration number, the authority's website address and a scannable QR code linking to the project's registration page, placed in the top-right corner, with the number and website in a font no smaller than the largest font used for contact details) and all other laws that apply to you; disclose any material connection with an endorser; display only products or services you are entitled to sell; and comply with Section 10 (prohibited content). You must hold all rights in the images, logos, trademarks and text you supply.
5.6 Our rights over Ads. We may review, approve, reject, pause, edit for format, or remove any Ad at any time, with or without notice, if we believe it breaches 5.5, these Terms or the law, or harms the experience of other users. Credits are not deducted for Ads we remove for our own reasons. Where an Ad is removed because it breaches these Terms, we may retain credits already consumed.
5.7 Refunds. Because credits are prepaid for your convenience, they are generally non-refundable. We will refund unused credits, to the original payment source within 10 business days, where: (a) we withdraw the Advertising Services or materially change them and you ask for a refund within 30 days of our notice; (b) we are unable to display an Ad you have paid for, for reasons attributable to us; (c) a refund is required by law; (d) your account is closed by you in good standing and you ask us for a refund of the unused balance; or (e) we suspend or terminate your account under Section 18.2 for any reason other than fraud, illegal activity or a material breach of these Terms. We do not refund credits consumed by Ads that were displayed.
5.8 No guarantee of results. We do not promise any number of views, clicks, enquiries, leads, orders or sales. Reported impressions are measured by our systems and are final except in the case of manifest error.
5.9 Labelling and fairness. All Ads and paid placements are labelled "Sponsored", "Featured" or "Ad" so that users can tell them apart from organic results. Where an advertiser is a related party of Bricko or of its directors, we disclose this on or near the placement. Sponsored placement does not alter a supplier's verification status, ratings or reviews.
5.10 Advertising data. Advertisers receive aggregated performance statistics only. We do not give advertisers the personal data of users who see their Ads. If a user sends you an enquiry or lead through an Ad, you receive only what that user chose to send, and you must use it for that enquiry alone, in line with Section 13 and our Privacy Policy.
5.11 Changes to prices. We may change advertising prices and formats at any time. Changes do not affect campaigns you have already booked for a stated period at a stated price.
6. The Platform: Bricko ERP, CRM and Unified Finance
6.1 Licence. Subject to these Terms, we grant your organisation a non-exclusive, non-transferable, revocable right to access and use the Platform for its internal business purposes.
6.2 Your data. All project, procurement, sales, customer, financial, employee and other data that you or your users upload to, or generate in, your workspace ("Customer Data") belongs to you. We process Customer Data only to provide, secure, support and improve the Services, as described in our Privacy Policy, and in accordance with our Data Processing Addendum, which is available on request and forms part of these Terms for Platform customers. You are the data fiduciary (controller) for Customer Data; we are your data processor.
6.3 Your responsibilities. You are responsible for the accuracy and lawfulness of Customer Data, for obtaining any consents required from your own customers, employees and contacts, for configuring user roles and permissions, and for how your users use the Platform.
6.4 RERA and statutory outputs. The Platform helps you track RERA compliance and prepare reports, registers, demand letters, receipts and statements. These outputs are generated from the data you enter. They are drafts and tools only. You remain solely responsible for reviewing them, for the accuracy of anything you file with MahaRERA or any other authority, and for your statutory obligations as a promoter, agent or taxpayer. Bricko is not a chartered accountant, lawyer or compliance adviser.
6.5 Integrations. The Platform may connect to third-party services (for example payment gateways, banks, messaging providers, accounting tools, e-way-bill utilities or maps). Your use of those services is governed by their own terms, and we are not responsible for them.
6.6 Availability and support. We make reasonable efforts to keep the Platform available, secure and backed up, and to fix defects we become aware of. We may carry out maintenance, with advance notice where practical. We do not guarantee that the free Platform will be uninterrupted or error-free, and we do not offer a service-level agreement for it.
6.7 Changes. We may add, modify or retire features. If we retire a feature that is material to the Platform, we will give at least 30 days' notice by email or in-app and, where practical, a way to export affected Customer Data.
6.8 Export and deletion. You can export your Customer Data at any time using the export tools in the Platform, and for 30 days after your workspace closes by asking us. After that period we delete Customer Data from live systems and purge it from backups in the ordinary course (normally within 90 days), except where the law requires us to keep it.
7. The Marketplace: BrickoMart
7.1 What Bricko does and does not do
(a) BrickoMart is an online marketplace. Suppliers, consultants, brands and delivery partners are independent businesses. When you buy goods or book a service on BrickoMart, the contract of sale or service is between you and that supplier or consultant. Bricko is not the seller, manufacturer, importer, service provider or carrier, does not take title to goods, and is not a party to that contract.
(b) Bricko is an intermediary under the Information Technology Act, 2000 and a marketplace e-commerce entity. We provide the technology, verify business details, display listings and prices submitted by suppliers, route requests for quotation and orders, display order and delivery status, provide invoices generated by suppliers, and help the parties resolve disputes.
(c) Bricko does not provide credit, loans or escrow. "Net 30/60/90" and similar credit terms, where offered, are extended by the supplier to the buyer at the supplier's own risk and discretion.
7.2 Verification
Suppliers, consultants and brands must provide a valid PAN and, where applicable, GSTIN, registered address, the bank account or UPI details to which the payment aggregator will settle online payments, and other documents we ask for. We check these against official databases where available and mark accounts "Verified" when checks pass. A Verified badge means that the business details were validated at the time of verification; it is not a guarantee of the quality, safety, legality or delivery of any goods or services. We may re-verify at any time and may suspend accounts whose details cannot be validated. For every supplier we display, on the supplier's page and at checkout, its legal name, geographic address, customer-care contact, GSTIN where applicable, ratings, and its return, refund, exchange, warranty, delivery and payment terms; listings show the country of origin of goods where the law requires it.
7.3 Listings, prices and quotes
(a) Suppliers set their own prices, stock, delivery areas, minimum order quantities, delivery charges and payment terms. Prices on BrickoMart are shown as supplied by the supplier and may be exclusive of GST and delivery; the checkout shows the full breakdown before you place an order.
(b) Bulk quotes (requests for quotation) are offers invited from suppliers. A quote becomes binding only when the buyer accepts it on the Marketplace, subject to the supplier's stated validity period.
(c) Suppliers warrant that their listings are accurate and lawful; that they hold all licences needed to sell the goods; that goods are genuine, of merchantable quality and as described; and that packaged goods carry every declaration required by the Legal Metrology (Packaged Commodities) Rules, 2011, including maximum retail price, net quantity, manufacturer or packer details, country of origin and consumer-care contact.
(d) Brands may publish catalogues and maximum retail prices and may designate authorised distributors. Brands are responsible for the accuracy of their catalogues, for their intellectual-property rights in them and for the pricing conduct of their distributors.
7.4 Ranking and placement
Unless you sort or filter results yourself, BrickoMart orders suppliers and products using the following main parameters, in decreasing order of importance: whether the supplier delivers to the pincode you entered; relevance to your search; price; availability; verification status; ratings and reviews; and past order performance (acceptance, fulfilment and on-time delivery). Paid placements are always labelled "Sponsored" or "Featured" (see 5.9). Apart from labelled Ads, we do not give any supplier preferential ranking for a fee. If we ever give a seller differentiated treatment other than through a paid Ad — for example a partner brand shown as a featured partner without payment — we disclose that on the listing and label it as advertising, and we disclose any related-party relationship.
7.5 Orders, payment and settlement
(a) An order is placed when you confirm it at checkout, and accepted when the supplier confirms it. The supplier may decline an order (for example for stock or serviceability reasons), in which case any amount paid online is refunded.
(b) Available payment methods are shown at checkout and may include pay on delivery (cash or UPI), bank transfer (NEFT/RTGS/IMPS) directly to the supplier, payment links issued through the payment aggregator, and online payment through a payment gateway. Online payments are collected by banks and payment aggregators authorised by the Reserve Bank of India and settled directly to the supplier's bank account under the aggregator's split-settlement arrangement. Bricko does not receive, hold, route or net off buyer funds, is not a party to the payment, and does not store your card or UPI credentials. Amounts you owe Bricko for Advertising Services are invoiced and paid separately and are never deducted from marketplace settlements. Any tax that the law requires an e-commerce operator to deduct or collect on facilitated transactions is handled as set out in 7.12.
(c) Every order carries a GST tax invoice issued by the supplier, who is the seller of record. Bricko does not issue invoices for goods.
(d) If you are a buyer on credit terms, you must pay the supplier on the due date. Bricko may show your dues and ledger to you and the supplier but is not responsible for collecting them.
7.6 Delivery
Delivery is arranged by the supplier, using its own vehicles or a delivery partner, to the site address you give. Delivery timelines are estimates. You (or your site representative) must be available to receive, inspect and sign for the goods. Check goods at the time of delivery and record shortages or visible damage on the delivery note and through the "Report an issue" option in your order within 48 hours.
7.7 Cancellations, returns and refunds
(a) Before dispatch, you can cancel an order from your Orders page. Any online payment is refunded to the original payment source within 7–10 business days.
(b) After dispatch, cancellations and returns are governed by the supplier's return policy, which is shown on the supplier's page and at checkout. Cement, sand, aggregates, cut-to-size steel, custom-made items and other goods that cannot be resold are generally not returnable unless they are damaged, defective or not as described.
(c) Damaged, defective or wrong goods must be reported within 48 hours of delivery with photographs. The supplier must replace the goods or refund the price (including delivery charges) within 7 business days of accepting the claim.
(d) Bricko does not charge any cancellation fee of its own. Suppliers may charge a cancellation fee only if it is disclosed before you order and only in the circumstances the Consumer Protection (E-Commerce) Rules, 2020 allow.
(e) Consultants' cancellation and rescheduling policies are shown on their profile and at booking.
7.8 Disputes between users
If you have a problem with an order, raise it from the order page first; the supplier must respond within 2 business days. If it is not resolved, you may escalate to our Grievance Officer (Section 20). We will review the order history, messages and evidence and may make a recommendation, and may ask the payment aggregator to process a refund under its dispute procedure where the supplier agrees or the facts clearly warrant it. Our recommendation does not prevent either party from pursuing its legal remedies.
7.9 Reviews and ratings
You may post reviews only of suppliers, consultants or products you have actually bought from or used. Reviews must be your own honest opinion. Suppliers and consultants may not post, buy, or offer incentives for reviews, or review themselves or their competitors. We may remove reviews that breach these rules and may flag verified-purchase reviews.
7.10 Consultants
Consultants (architects, engineers, interior designers, project-management consultants, green-building and vastu consultants and similar professionals) are independent professionals who are solely responsible for their qualifications, registrations, advice and work. Bookings made on BrickoMart are agreements between you and the consultant; consultation fees are agreed with and paid to the consultant. Nothing on BrickoMart is professional advice from Bricko.
7.11 Delivery partners
Delivery partners and drivers are independent contractors of the supplier that engages them, not employees or agents of Bricko. The driver app asks for your separate, specific consent before it shares your live location with the supplier and the buyer while a delivery is in progress; you can withdraw that consent in the app, in which case live tracking stops.
7.12 Taxes on marketplace transactions
Suppliers are responsible for charging, collecting and depositing GST on their sales and for complying with e-way-bill and e-invoicing rules. Where income-tax or GST law requires an e-commerce operator to deduct or collect tax on transactions facilitated through the Marketplace, we will do so and issue the relevant certificates.
8. The Home Buyer Portal
8.1 The Portal shows homes and inventory from builders and promoters who use Bricko, and lets you track bookings, payment schedules, demand notes, receipts and documents that your builder makes available through the Portal.
8.2 Bricko is not a real-estate agent or broker. We do not negotiate, sell, or earn commission or brokerage on any home, and we do not represent either the builder or the buyer. All information about a project — including price, area, specifications, amenities, possession date and RERA registration — is provided by the builder, who is responsible for it under the Real Estate (Regulation and Development) Act, 2016. Verify project details on the website of the relevant Real Estate Regulatory Authority (for Maharashtra, maharera.maharashtra.gov.in) before you make any payment.
8.3 Bookings, agreements for sale, payments and possession are between you and the builder, under the builder's own agreement and the applicable RERA rules. Payments are made directly to the builder (or its designated RERA project account), never to Bricko. The payment schedule and receipts shown on the Portal are the builder's records; if they differ from your agreement, your agreement prevails.
8.4 The Portal may show links to lenders or home-loan information. These are links only. Bricko is not a lender, direct selling agent or lending service provider; loan decisions are made solely by the lender. Bricko does not arrange, recommend or broker loans, does not receive your loan application, and does not pass your details to any lender unless you give separate, specific consent naming that lender.
8.5 Three-dimensional views, renders and visualisations are illustrations and may not be exact. AI-generated or digitally created visuals are labelled as such.
8.6 Real-estate agents and channel partners. If you use the Services to introduce buyers to builders, market real-estate projects or otherwise act as a real-estate agent or channel partner, you must hold a valid agent registration (and, in Maharashtra, the MahaRERA agent competency certificate) under the applicable real-estate law, display your registration number on your profile and in every advertisement, and renew it when due. You must not promote any project that is not registered with the competent Real Estate Regulatory Authority where registration is required. We may verify your registration at onboarding and at any time, and may suspend accounts that cannot show it.
9. Your content
9.1 "User Content" means anything you post, upload or submit to the Services — listings, catalogues, photographs, logos, documents, messages, reviews, enquiries, profiles, project information and Customer Data.
9.2 You keep ownership of your User Content. You grant Bricko a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for formatting and technical purposes), and transmit your User Content solely to operate, secure, support, improve and promote the Services, for as long as the content remains on the Services (and afterwards only as needed to comply with law or resolve disputes). Suppliers, consultants and brands additionally allow us to display their public listings, catalogues, names and logos in search results, category pages, Ads they book and Bricko's marketing of the Marketplace.
9.3 You are responsible for your User Content. You confirm that you have the right to post it and that it does not breach Section 10.
9.4 We do not monitor User Content proactively and do not endorse it, but we may review, label, limit the reach of or remove content that we reasonably believe breaches these Terms or the law.
10. Prohibited content and conduct
10.1 You must not host, display, upload, modify, publish, transmit, store, update or share any information or content that:
- belongs to another person and to which you do not have any right;
- is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, related to or encouraging money laundering or gambling, or otherwise unlawful in any manner;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- violates any law for the time being in force;
- deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
- impersonates another person or business;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, prevents investigation of any offence, or insults any other nation;
- contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
- is patently false and untrue, and is written or published in any form with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person;
- is synthetically generated (AI-generated or altered audio, image or video) and is not labelled as such, or has had such a label removed;
- relates to, or advertises, an online game that is not permitted under applicable law, including any online money game;
- promotes, in relation to a real-estate project, any project that is not registered with the competent Real Estate Regulatory Authority where registration is required, or omits the registration number, the authority's website or, where required, the QR code (see 5.5).
10.2 You must also not:
- post false, inflated or misleading prices, stock, specifications, certifications, delivery promises or business credentials;
- sell counterfeit, stolen, unsafe, expired, banned or restricted goods;
- use the Services to send unsolicited commercial messages, scrape data, harvest contact details, or build a competing database;
- bypass or try to bypass the Marketplace to avoid our Terms once a buyer and supplier have been introduced through it, where that would involve deceiving the other party;
- manipulate rankings, reviews, quotes, ad auctions or verification;
- probe, scan, overload, reverse-engineer, or interfere with the security or operation of the Services;
- use the Services for any purpose that is illegal where you are, or in breach of sanctions or export-control laws;
- use any automated means to access the Services except through APIs we publish and permit.
10.3 Reminder. As required by the Intermediary Guidelines, we remind you — at least once every three months, by email, in-app notice or similar — that failing to comply with these rules may lead to immediate removal of content, termination of your account, and may expose you to legal consequences under the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023 and other laws.
10.4 Removal and preservation. We will remove or disable access to unlawful content within 3 hours of receiving a court order or a notice from an authorised government agency, and may do so on our own assessment in other cases. Complaints from users about content that breaches 10.1 are actioned within 36 hours; complaints about content showing a person's private areas, nudity or sexual act, or impersonating a person (including morphed images), are actioned within 2 hours. We preserve removed content and associated records for 180 days, or longer if required by a court or government agency, and we retain account registration information for 180 days after an account is cancelled or withdrawn. We may provide information to law-enforcement and government agencies when lawfully required.
11. Intellectual property
11.1 The Services, including all software, designs, text, graphics, logos, data compilations, 3D models, documentation and the names BRICKO, BRICKOMART and BRICKO ERP, and the brick logo, are owned by or licensed to Bricko and are protected by Indian and international intellectual-property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights.
11.2 You may not copy, modify, distribute, sell, lease, sublicense, reverse-engineer or create derivative works from any part of the Services, or use our trademarks, without our prior written consent. Suppliers, consultants and brands may describe themselves as "available on BrickoMart" and use the badges we provide for that purpose, in accordance with any brand guidelines we publish.
11.3 If you give us feedback or suggestions, you allow us to use them without any obligation to you.
11.4 If you believe content on the Services infringes your intellectual-property rights, write to our Grievance Officer (Section 20) with details of the right, the content and its URL, and a statement that you are the rights holder or authorised to act for them.
12. Third-party services and links
The Services may link to, embed or integrate services and websites that we do not control, including payment gateways, banks, lenders, maps, messaging platforms, RERA and government portals, and the websites of suppliers, brands and builders. We are not responsible for their content, policies or practices, and your use of them is at your own risk and subject to their terms.
13. Privacy and communications
13.1 Our Privacy Policy is our notice explaining what personal data we collect, why, how we share it, how long we keep it and the rights you have. We ask for your consent to the processing it describes through separate, specific affirmative actions — at sign-up (service, marketing, and sharing with other users are separate choices) and when you enable features such as precise location — and we keep a record of each consent. Withdrawing a consent is as easy as giving it.
13.2 Data you receive from other users. Suppliers, consultants, brands, delivery partners and builders receive personal data of other users (for example a buyer's name, site address and phone number for an order, or a lead's contact details) only for the purpose of that order, enquiry or booking. You must use it only for that purpose, protect it, not sell it or add it to marketing lists without the person's separate consent, delete it when no longer needed, and comply with the Digital Personal Data Protection Act, 2023 and any other applicable data-protection law. You are the data fiduciary for your own use of such data.
13.3 Messages from us. We send transactional and service messages (one-time passcodes, order and delivery updates, quote notifications, demand notes, security alerts, changes to these Terms) by SMS, WhatsApp, email, in-app notification or phone. These are part of the Services. We send marketing messages only with your opt-in consent, which you can withdraw at any time.
14. Confidentiality
Business users may, through the Services, see non-public information of other businesses (for example quotes, pricing, ledgers, project details). You must keep such information confidential, use it only for the transaction it relates to, and not disclose it to third parties, except as the law requires. Bricko keeps Customer Data and your non-public business information confidential and discloses it only as described in these Terms and the Privacy Policy.
15. Disclaimers
